  • What is the GDPR?

    The General Data Protection Regulation (GDPR) is a legal framework that sets guidelines for the 

    collection and processing of the personal information of individuals. (Referred to as Data Subjects). Since Brexit, the UKGDPR and Data Protection Act 2018 must be followed by all organisations. 

  • What is personal data?

    Personal data is information that relates to an identified or identifiable individual. What identifies an individual could be as simple as a name or home address or could include other identifiers such as email addresses, National Insurance number or even an IP address. 

  • Do I need a DPO for my school, college or university?

    GDPR mandates the appointment of a DPO for all public bodies including all state-run schools. 

    Independent places of learning should also consider appointing a DPO because their core activities involve “regular and systematic monitoring of data subjects on a large scale”.

  • What skills must a DPO have?

    The DPO must be independent, an expert in data protection, adequately resourced, and report to 

    the highest management level. A DPO can be an existing employee or externally appointed. There 

    should be no conflict of interest in the role.

    This therefore should exclude Chair of Governors, Head Teacher, Finance Officer Head of IT, etc..

  • What does the DPO role involve?

    The DPO takes an independent monitoring compliance with the UK GDPR and other data protection laws. They oversee data protection policies, awareness-raising, staff training, and audits. They are the point of contact for data subjects, e.g. pupils, parents and staff, and the ICO 

    (Information Commissioner's Office).

  • What is a Data Controller?

    The GDPR defines a controller as: the natural or legal person, public authority, agency or other body which, alone or jointly with others, determines the purposes and means of the processing of personal data. Controllers make decisions about processing activities
